1. Scope & Acceptance
These Terms of Service govern the use of the app provided by Vinh Tran (Namereload). By downloading, accessing, or using the app, you agree to be bound by these terms. If you do not agree, do not use the app.
2. Description of Service & No Professional Advice
The app provides digital note-taking, voice recording, and reminder features. The service is provided on an "AS IS" and "AS AVAILABLE" basis. The app and its transcriptions do not constitute professional, legal, financial, or medical advice.
3. Subscriptions, In-App Purchases & Payments
- The app may offer paid features, auto-renewing subscriptions, or in-app purchases.
- All financial transactions, billing, and subscription management are handled securely through the respective official app stores (Apple App Store or Google Play Store) and are subject to their terms and conditions.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period through your store account settings.
- Price changes and refund requests are governed by the policies of Apple or Google, and we cannot issue direct monetary refunds.
4. Intellectual Property Rights
All rights, title, and interest in and to the app (including software, design, text, graphics, and trademarks like "Namereload") are and will remain the exclusive property of Vinh Tran. Users receive a personal, non-exclusive, non-transferable license to use the app.
5. Limitation of Liability & Disclaimer of Warranties
- To the maximum extent permitted by Swiss law, the developer (Vinh Tran) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption.
- We assume no liability for data loss due to technical failures, cloud outages, user error, or unbacked-up data. Users are solely responsible for maintaining external backups.
- We are not liable for any disruptions caused by internet service providers, mobile network failures, or third-party API dependencies.
6. User Responsibilities & Indemnification
Users agree to use the app lawfully. You agree to indemnify, defend, and hold harmless Vinh Tran from and against any claims, liabilities, damages, losses, and expenses arising out of your misuse of the app or violation of these terms.
7. Account Termination & Service Modification
We reserve the right to modify, suspend, or terminate the app or your access to it at any time, without notice, for any reason. We may update these terms at our discretion; continued use constitutes acceptance.
8. Governing Law & Jurisdiction
These terms shall be governed by the laws of Switzerland. The exclusive place of jurisdiction for any disputes shall be the registered address of the operator in Bözberg, Switzerland.
